Nomination au Centre Talibou Dabo : le ministère de la Santé réagit à l’arrêt de la Cour suprême
In a press release, the Ministry of Health and Social Action wished to provide clarification, following the publication, on August 6, 2025, of a Supreme Court ruling annulling an appointment to head the Talibou Dabo Center.
Decision No. 31, dated May 8, 2025, follows an appeal filed by the outgoing Director of the Talibou Dabo Center on September 23, 2024. He then contested his replacement by an order of the Minister of Health, issued on August 1, 2024 under number 017689. Upon referral, the supreme judge decided to annul said order.
In its press release, the Ministry of Health and Social Action states that "the appointment of the new - and current - Director of the Talibou Dabo Center does not suffer from any irregularity." It specifies that this ministerial decision was taken "in accordance with Decree No. 2020-936 of April 3, 2020, on the organization of the Ministry of Health and Social Action, amended by Decree No. 2023-1321 of July 12, 2023."
The appeal brought by the outgoing Director was based on an interpretation of the principle of parallelism of forms. He argued that he could only be replaced by decree, as was the case when he was appointed by decree no. 2019-1022 of June 13, 2019. The press release recalls, in this regard, that "the outgoing Director […] had filed an appeal for annulment before the Supreme Court, citing non-compliance with the principle of parallelism of forms."
The ministry expressly cites article 89 of the decree governing its organization, according to which: "Heads of Department and Heads of Unit are appointed by order of the Minister of Health and Social Action."
He adds that this provision, although not retroactive, "applies to all legal situations subsequent to its entry into force."
On this basis, the ministry's services believe that the appointment of a new Director for the Talibou Dabo Centre "could not disregard the provisions of Article 89 and could only be done by decree".
To support its position, the administration recalls that in 2018, before the appointment by decree of 2019, a Director of the Talibou Dabo Center had already been appointed by ministerial decree no. 00087 of January 5, 2018.
Finally, the press release returns to the measures taken following the appeal. It states that "immediately after the filing of the appeal for annulment, which was followed by the Supreme Court's suspension of the Minister of Health and Social Action's order," the latter requested and then obtained Decree No. 2024-3081 of November 15, 2024, terminating the functions of the outgoing Director. Following this, a new decree - No. 029508 dated November 20, 2024 - was issued to appoint the current Director of the Talibou Dabo Center.

Comment un ministère peut il sortir un communiqué défiant la décision de la cour suprême. Certaines cellules juridiques des ministères vraiment n'ont plus aucune connaissance des principes les plus élémentaires du droit notamment la séparation de pouvoir. Khalifa Sall l'avait dit que ce qui est malheureux dans ce pays c'est que dès que la personne a un master il est nommé et c'est très dangereux pour un état. Et c'est ce qui va détruire le projet de Sonko car la plupart des personnes qu'il nomme issues de sa base n'ont aucune expérience professionnelle et aucun parcours. Dieu est Grand. Respectez les magistrats.
Vous avez dit Chefs de services et Chefs de cellules alors que là il s'agit d'un Directeur d'un centre. Donc la cour suprême à raison non ??

En plus ses incompétents collaborateurs du Ministre qui ont failli à leurs missions de Conseil persistent pour se donner une porte sans issue suite à la décision de la Cour Suprême. Il suffisait simplement de passer par le Conseil des Ministres pour changer ce Directeur très républicain.
pourquoi ça ??? Enfin, le communiqué revient sur les mesures prises à la suite du recours. Il indique qu’« aussitôt après l’introduction du recours en annulation, qui a été suivi de la suspension par la Cour suprême de l’arrêté du Ministre de la Santé et de l’Action sociale », ce dernier a sollicité puis obtenu le décret n°2024-3081 du 15 novembre 2024, mettant fin aux fonctions du Directeur sortant. Dans la continuité, un nouvel arrêté -n°029508 daté du 20 novembre 2024- a été pris pour nommer l’actuel Directeur du Centre Talibou Dabo.
