FADP : L’APPEL dénonce des violations graves et le retour d’une plateforme défaillante
The latest decision by the Ministry of Communication, Telecommunications and Digital Affairs (MCTN) to use the media and media declaration platform (DMS) as part of the new procedure for distributing the Press Support and Development Fund (FADP) is infuriating the Association of Online Press Publishers and Professionals (APPEL).
According to the organization, this platform, already at the heart of numerous controversies during the media compliance process, continues to suffer from serious malfunctions. "Indeed, from the moment the Media and Support Platform (DMS) was launched, IT specialists and journalists who were members of our association, after conducting tests, were unpleasantly surprised to discover significant shortcomings and documented bugs (see screenshots sent to the authorities). Recurring malfunctions in the database led to the loss of documents crucial for the compliance of numerous media outlets, thus unfairly causing their exclusion. These malfunctions were, however, reported and denounced last February by APPEL. While the Communications Department initially acknowledged "errors," it subsequently inexplicably retracted its statement. It is therefore incomprehensible that the fate of press companies is once again tied to the "whims" and technical problems of a platform recognized as flawed," the association stated indignantly.
APPEL also says it supports the statement from the Council of Press Broadcasters and Publishers (CDEPS) which points to serious shortcomings in decree 2021-178 setting the rules for managing the FADP.
The association alleges abuse of power and ineligibility, citing in particular the remarks of the Director of Communications at RTS. He reportedly indicated that the ministry intends to support ineligible entities such as RTS and the Press House, in violation of Articles 9 and 10 of the decree.
The APPEAL also denounces the lack of consultation with the fund's Management Board, a body provided for in articles 4 and 5 of the text, but put in parentheses by the supervisory authority.
A referral to the CDP has been announced.
Another point of concern is the alleged violation of the law on the protection of personal data. APPEL considers it paradoxical that a public authority, which advocates transparency, could itself break the regulations.
Faced with these multiple violations, the association plans to appeal to the Commission for the Protection of Personal Data (CDP) in order to force the ministry to comply with the rules it imposes on the press.
In conclusion, the APPEAL demands the immediate suspension of the FADP allocation process and calls for a comprehensive review of the legal and technical framework governing the process. The organization advocates for transparent and equitable management of the fund, free from any favoritism or irregularities.
