Hausse des tarifs de Canal+, gratuité des chaînes nationales : L’Etat du Sénégal a décidé d'agir
The State of Senegal has decided to act in response to the increase in prices for Canal+ Senegal's pay-TV packages and the lack of free access to national channels.
Indeed, following a complaint from the Forum of Young Consumers of Senegal denouncing an average increase of 10% in the rates applied by Canal+ Senegal, the Ministry of Communication, Telecommunications and Digital Affairs announces that it has "officially referred the matter to the President of the National Audiovisual Regulatory Council (CNRA)".
The said referral aims to examine the legality and justification of this increase, to assess its impact on consumers and to propose, where appropriate, corrective measures intended to guarantee transparency and the protection of subscribers.
Furthermore, with regard to free access to national channels, the ministry recalls that article 161 of the Press Code expressly states that "every distributor shall make general public audiovisual services available free of charge to its subscribers, unless the latter consider that the service offer is manifestly incompatible with the respect of their public service missions".
Therefore, according to the department headed by Alioune Sall, this provision establishes a "legal obligation to provide free public service channels in any distribution offer, an obligation that applies to all operators, including Canal+ Senegal."
Therefore, the Ministry of Communication, Telecommunications and Digital Affairs, in collaboration with the CNRA (National Audiovisual Regulatory Council), assures that it will ensure this requirement is reiterated and enforced in distributor agreements and specifications. It announces that instructions will be issued for the effective implementation of Article 161.
"The Government remains attentive to any tariff or contractual imbalance likely to infringe on the rights of users and the principle of universal access to information," the ministry said, in response to a written question from MP Guy Marius Sagna.
Indeed, the price increase for Canal+ Senegal came about following the application of tax provisions imposed on it by the State of Senegal. These provisions require the distributor to pay 9% of its revenue, as indicated by MP Guy Marius Sagna in a written question last July.
