Affaire Farba Ngom : «Rétablir l'équilibre des citoyens devant la loi»
The Indictment Chamber of the Dakar Court of Appeal confirmed on Thursday the provisional release granted to Farba Ngom. By upholding the order of the Financial Judicial Pool (PJF), the court overruled the Financial Prosecutor's Office, which had strongly opposed the release of the APR official.
Unequal treatment highlighted
According to L'Observateur, which reported the story, the legal debate has centered on an apparent procedural inconsistency. Farba Ngom and businessman Tahirou Sarr are being prosecuted in the same money laundering and fraud case involving 125 billion CFA francs. However, the same source points out that while the investigating judge granted both men their release on January 12, the Financial Prosecutor's Office only appealed against the mayor of Agnam, allowing Tahirou Sarr to leave prison.
The Indictment Chamber ultimately followed the arguments of the defense and those of civil society organizations, notably the Forum of the Justiciable, considering that this differentiated treatment lacked consistency and violated the principle of equality of citizens before the law.
While Farba Ngom has won a round, his release from prison is not yet a done deal. His fate now depends on the decision of the Public Prosecutor's Office. The latter has six days to file an appeal. Such an appeal would immediately block his release.
Faced with this possibility, Babacar Ba, leader of the Forum of the Justiciable, issued a call for "clear-headedness" in the pages of the Groupe Futurs Médias daily newspaper. He urged the Attorney General at the Dakar Court of Appeal to refrain from any appeal, in order to preserve the credibility of the judicial institution and put an end to this procedural imbalance.
