Burkina Faso : Le contrat à durée déterminée (CDD) ne pourra désormais être renouvelé que deux fois au maximum
The Burkinabe government has adopted a bill revising the Labor Code. Among the main measures, fixed-term contracts (CDDs) can now only be renewed a maximum of two times. In the event of dismissal, the maximum period for calculating damages has been raised from 18 to 24 months.
The text also introduces a principle of equal pay. For equivalent qualifications and positions, a temporary worker must receive the same pay as an employee of the user company. Furthermore, any person with a conflict of interest with that company will be ineligible to enter into a temporary staffing contract.
The project also provides for an increase in the appeal threshold after a judgment, which goes from 200,000 FCFA to 1 million FCFA, constituting one of the major innovations of the text.
