Acquisition de produits pétroliers et gaziers : l’Arcop dit «stop» à Petrosen Trading & Services
The French public procurement regulator (Arcop) has, this time, put a stop to Petrosen Trading & Services' request. This company had sought a third extension of its authorization to acquire petroleum and gas products "without application of the Public Procurement Code, pending the finalization of the regulatory framework establishing this exceptional regime."
In its correspondence addressed to the regulatory authority, the company recalled that a first derogation for a period of six (06) months had been granted to it on February 19, 2025. It was followed by a second extension of three (03) months on July 31, 2025.
As the amendment to the decree on the list of goods and services benefiting from an exemption has not yet been finalized, the Minister of Finance has invited the Ministry of Petroleum to consider a new referral to Arcop for the management of the transitional period, Petrosen indicated.
However, the regulatory authority clarified this time that the exemption is an exceptional measure to preserve the public interest. "It cannot be established as a rule to the point of replacing the decree provided for in Article 3 of the Public Procurement Code," it stated.
This provision of the public procurement code provides for an exemption in favour of public companies responsible for the application of petroleum policy, the marketing of petroleum and gas products, as well as the construction, operation and maintenance of natural gas transport and distribution infrastructure.
However, "the acquisitions of goods, equipment and services covered by this exemption are carried out under the conditions set by a joint decree of the Minister in charge of Finance and the Minister in charge of Energy, after approval by the body in charge of regulating public procurement."
Since this decree was not available, Arcop simply rejected Petrosen Trading & Services' request.

Vraiment un arrêté qui depuis un an n'est toujours pas disponible. Il s'agit d'un arrêté, un texte administratif pour fixer les règles d'acquisition ayant par essence une période de validité ne pouvant dépasser trois mois, renouvelable une seule fois. Quoi dire de plus pour étayer que l'administration ne travaille pas dans ce pays. Sachant que sur les prés de 5 000 milliards de recettes prévues plus de la moitié soit 3 100 milliards sont prévus pour les salaires (1500mds) et frais de fonctionnement (1600mds) du personnel public. Soit plus de la moitié des recettes fiscales prélevées sur les gains des citoyens sénégalais qui vont dans les poches de fonctionnaires qui ne travaillent pas. Et il est évident que beaucoup de documents et textes ne sont pas à jour dans ce pays.
S'il y a un groupe qui bouffe comme trois et qui n'est pas performant dans ce pays, c'est bien l'administration publique.
