The Thiès court examined on Monday a case of intentional assault and battery involving a young shepherd, Mr. Tine, aged about 20, and an 89-year-old farmer, S. Faye.
According to the facts presented in court, the defendant had driven his flock into the old woman's field. When she asked him to leave, he attacked her, causing injuries to her right hand and left hip.
Armed with a medical certificate attesting to a seven-day temporary incapacity for work (ITT), the complainant filed a complaint with the police. The young shepherd was arrested and remanded in custody pending trial.
In court, Mr. Tine denied the facts. He maintained that the old woman had brandished a knife to attack him and that it was while trying to take the weapon away from him that she had injured her hand.
The complainant firmly rejected this version of events, claiming she was first insulted and then assaulted. "He injured my hand and hip," she stated, demanding 500,000 CFA francs in damages. The public prosecutor considered the facts established and requested that the law be applied.
At the conclusion of the proceedings, the court found the defendant guilty of assault and battery. He was sentenced to one month's imprisonment, suspended, and ordered to pay 200,000 CFA francs in damages to the victim.
