Plainte pour « discrimination » de l’athlète transgenre Halba Diouf : la justice donne raison à la Fédération française d’athlétisme

The Paris criminal court has ruled. On Wednesday, January 28, 2026, the French Athletics Federation (FFA) was acquitted of the discrimination and harassment charges brought by transgender sprinter Halba Diouf. This decision brings to an end, at least temporarily, a legal battle that began nearly four years ago between the athlete and her governing body.

Halba Diouf accused the French Athletics Federation (FFA) of preventing her from competing in national women's competitions, arguing that this restriction constituted discrimination based on her gender identity. The issue at hand was the French federation's application of rules established by World Athletics, which limit the access of transgender athletes to elite women's competitions.

At the end of the hearing, the court ruled that the elements constituting the offenses were not established. The judges determined that the FFA had not acted with discriminatory intent, but had merely applied an international regulatory framework, without any remarks or behavior amounting to psychological harassment.

For Halba Diouf, this decision represents another blow in a battle she has been waging for several years to be able to compete at her best. "It's a form of rejection, I find it sad," she lamented. Her lawyer expressed his disappointment, believing that the federation was hiding behind a contested international regulation, and announced his intention to consider an appeal.

For its part, the French Athletics Federation welcomed the decision with restraint, simply stating that it acknowledges the judgment, without further comment.

Beyond the individual case of Halba Diouf, this affair raises a sensitive and still debated question: the place of transgender athletes in competitive sport. This debate, at the crossroads of law, ethics, and athletic performance, continues to divide the world of athletics as well as the entire sporting movement.
