Accès à l’information : Le gouvernement amende le projet de loi pour plus de "clarté et d’efficacité"
During the examination of the draft law on access to information in the National Assembly, the Minister of Justice, Ousmane Diagne, presented several amendments aimed at clarifying and strengthening the provisions of the text.
The first amendment modifies Article 15 to clarify the procedures for transferring requests. When a subject public or private body receives a request for information that it does not hold, it is required to forward it to the competent entity within a maximum of five days, "by any appropriate means." This measure aims to avoid administrative blockages for citizens.
The second amendment, relating to Article 27, corrects material errors and establishes the creation of the National Commission for Access to Information (CONAI), an independent administrative authority with legal personality. CONAI's missions will be to promote and protect the right of access to information, raise awareness and train citizens and institutions, investigate, issue recommendations, compel those subject to comply with their obligations, propose legislative reforms, give opinions, support the stakeholders concerned, receive appeals in the event of refusal or non-response, and publish an annual report on the state of access to information in Senegal.
Finally, a third amendment removes an erroneous reference to "Article 33" inadvertently inserted into Article 30. "These amendments reflect the government's desire to strengthen transparency and guarantee the effectiveness of the right to information," the minister said.
