Recours contre l’éviction de Barthélémy Dias à la mairie de Dakar : La Cour suprême va trancher à 12h
Barthélémy Dias is on the verge of permanently losing his seat as mayor of Dakar following his conviction in the Ndiaga Diouf case. The ousted mayor has appealed to the Supreme Court to challenge the Senegalese government's decision. The case has been scheduled for a hearing on September 18, 2025. The Attorney General has requested that the appeal be dismissed. Representing Barthélémy Dias, Mr. El Hadji Amadou Sall referred to his submissions already filed with the Court.
However, the lawyer made some observations, denouncing the procedure. In particular, he criticized the fact that the Dakar prefect convened the city council on August 25, 2025, to elect a new mayor, even though the Supreme Court had scheduled its hearing for September 18. For Mr. Sall, this constitutes an attack on the separation of powers.
State Judicial Agent (AJE), Bouna Diakhaté, stated that he had no observations to make, stressing that the defense had not raised "any legal argument" in its pleadings. His remarks were supported by State lawyers, Me Masokhna Kane and Khady Camara, who also referred to their submissions. For his part, the Attorney General confirmed his conclusions, requesting the dismissal of the request. Before adjourning the case for deliberation at 12 p.m., the presiding judge reprimanded Me Amadou Sall: "The Supreme Court hearing cannot prevent the prefectural authority from proceeding," he declared.

Tout le monde sait que la requete de Barthe sera rejeté, lui meme a déjà tourné la page mais les journalistes aaiment nous bercer dans le sensationnalisme, normalement cet article aurait du etre ecrit par un journaliste avec des competences en droit pour eclairer les lecteurs malheureusement actuellement on fait plus du recopiage coller que du journalisme.
