Chambre criminelle de Mbour : La perpétuité requise contre un voleur de téléphone devenu meurtrier
On September 19, 2020, officers from the Joal gendarmerie brigade arrested Moustapha Gueye, who was being prosecuted for theft and murder. The incident occurred in the middle of the night in Joal.
According to information presented at the Mbour criminal court hearing, Oumy Sène felt hands searching her belongings that night before stealing her cell phone. She immediately began screaming, alerting her family members who gave chase to the suspect.
Serigne Saliou Ndour was reportedly the first to catch the alleged thief. It was at this moment that the latter allegedly stabbed him twice. According to the prosecution, the injuries inflicted were fatal.
In court, Moustapha Gueye admitted to striking blows, claiming to have used an iron. He maintained, however, that he acted in the heat of the moment and also stated that he had been injured by members of the victim's family.
Serigne Saliou Ndour's mother, for her part, described the accused as a repeat offender, stating that he "spends his time stealing." She also indicated that his fingers had been amputated by fishermen during a previous theft.
The prosecutor described the acts as extremely violent and requested a life sentence.
For her part, defense attorney Rama Ba argued that there was no intent to kill. According to her, her client acted in self-defense in the dark, without knowing where the blows would strike the victim. She therefore requested that the charges be reduced to simple robbery. The case was adjourned for deliberation until March 20, 2026.
