SM Ndiaye, 24, is being prosecuted for rape and pedophilia. He is accused of having non-consensual sexual relations with N. Ndiaye, a minor aged 12 at the time of the events, which took place in 2022 in Tivaouane.

According to the victim, the defendant found her sitting in one of the bedrooms of their home around 8 p.m. SM Ndiaye then asked her to have sex with him. When she refused, he threw her onto the bed and raped her. "He forced me. I didn't scream because he gagged me," explained N. Ndiaye.

SM Ndiaye denied the accusations. According to him, "on the night in question, (he was) at the victim's home. We were together in the bedroom, but I did not lay a hand on her. We were talking and suddenly, she came out of the room screaming that she had been raped. I did not rape her."

A. Fall, the victim's mother, stated that she was the one who caught them in the bedroom in an unambiguous position. "That night, I had gone to a meeting. When I returned, I caught SM Ndiaye in this dark room having sexual relations with my daughter. When I turned on my phone's flashlight, I saw him on top of my daughter. His pants were down to his knees. He jumped and tried to run away. I grabbed him to stop him. I was shocked when I came across that scene," she testified.

The defense, represented by Mr. Faty, argued for the defendant's acquittal based on reasonable doubt. He emphasized that the medical certificate submitted to the case file attested to a previous tear of the hymen. The prosecutor maintained that the defendant was guilty of the charges and requested a 10-year prison sentence.

The case was adjourned for deliberation until February 10, 2026.

"d'avoir entretenu des rapports sexuels non consentis avec la fille", le consentement d'une mineure m'a aucune valeur. Tu ne touche pas a une mineure meme elle est d'accord. Meme si elle avait consenti, tu aurait ete pareillement accuse de viol et pedophilie.
