THIÈS CRIMINAL COURT: On trial for the rape of his cousin, Mr. Ndieguène cries conspiracy

CHAMBRE CRIMINELLE DE THIÈS : Jugé pour le viol de son cousin, M. Ndieguène crie au complot

A bricklayer by trade, Mr. Ndieguène appeared in court on Monday, January 12, charged with rape and unnatural acts against his cousin, D. Ndieguène, who has a mental disability. The events date back to September 15, 2021, in Thiès.

In court, the defendant firmly denied the accusations, denouncing a conspiracy orchestrated by the victim's older brother. Mr. Ndieguène insisted: "I am not sick. I am not homosexual. I have never had sexual relations with a man." He then emphasized that he had a dispute with the victim's older brother and that the latter had threatened to make his life difficult.

According to the testimony of the victim's brother, the accused led D. Ndieguène to his room under the pretext that he was going to offer him clothes before raping him.

"When I was informed of the facts, I questioned D. Ndieguène and he confirmed that M. Ndieguène raped him. To be sure, I took him to the hospital. The doctor examined him and found sperm and tears in his anal area. He also had injuries to his hand. Traces of sperm were also found in the accused's room," said the victim's brother.

He emphasized that this was the second time the defendant, Mr. Ndieguène, had committed such an act against D. Ndieguène. "The first time, due to the mediation of his parents, I did not take legal action. This time, I have taken legal action to put an end to his actions, because my little brother, D. Ndieguène, has been mentally ill since he was very young," he confided.

Called to the stand, the victim categorically refused.

Despite suspicions arising from testimonies and the discovery of traces of sperm in his room, the public prosecutor requested acquittal on the grounds of reasonable doubt, believing that the evidence did not allow him to establish his guilt with certainty.

Deliberated on February 9, 2026.
