25-year-old K. Ba is on trial for rape, pedophilia, and abduction of 14-year-old M. Mballo. The events took place in 2022 in Thiès.

In court, he admitted to having had sexual relations with the girl on three occasions, but denied any rape. He claimed that the events took place in his room and that the girl had come of her own free will.

"I never forced her to come to my house. She was the one who made contact and sent me her photos. That's how our relationship started. I made a mistake. I shouldn't have acted that way," he said.

But the victim contradicted the defendant's statements. She declared that she was not in a romantic relationship with K. Ba and that during the first rape, it was he who had invited her to his room. It was under these circumstances that he forced her to have sexual relations.

However, during the preliminary investigation, she had stated that she was in a romantic relationship with the accused and that she had consented during the last two sexual encounters.

The mother testified that her daughter had never spoken to her about the rape. She explained that it was only after discovering her pregnancy that her daughter revealed the events. The mother emphasized that she was against the relationship and had forbidden the boy from approaching her daughter. "I filed a complaint because he refused to acknowledge paternity," she stated.

The public prosecutor determined that the charges of pedophilia and abduction of a minor were substantiated. Regarding the rape charge, he argued that the victim did not consent during the first sexual encounter due to the element of surprise. The prosecution therefore concluded that K. Ba was guilty on all counts and requested a five-year prison sentence.

The verdict is scheduled for February 24, 2026.
