I. Sène appeared before the criminal court of the Thiès High Court on charges of destroying property belonging to others. He is accused of destroying the wall built by Ms. P. Mbaye on her property. The incident occurred in Tivaouane in 2025.

In court, the defendant admitted that the victim's building had been damaged, but denied being the perpetrator or instigator. He claimed the wall had been destroyed by vehicles, arguing that it encroached on the public right-of-way.

“When I noticed that this woman had built on the public road, I contacted the town hall and the land commission so that they could resolve the problem. I did not touch this construction. I simply alerted the competent authorities,” he said.

For his part, the elderly D. Ndiaye asserted that it was I. Sène who destroyed the wall. He specified that he was the seller of the plot to P. Mbaye and maintained that it was not located on a public road.

In turn, the plaintiff, P. Mbaye, confirmed that she had acquired the land from D. Ndiaye. She explained that she had mobilized all her resources to begin construction, before discovering with dismay the destruction of her wall.

The public prosecutor has requested the application of the law.

Mr. Faty, the lawyer for the plaintiff, argued that the defendant was responsible for the destruction, emphasizing that he was the only one taking steps to stop the work without having the authority to do so. He demanded five million CFA francs in damages.

The verdict is scheduled for May 5th.
