Fonds Force Covid-19 : La Cour suprême confirme la liberté provisoire du chauffeur de l’ex-ministre Moustapha Diop
The Supreme Court ruled this Thursday, December 18, 2025, in the case between the public prosecutor and Mouhamadou Bamba Amar. The high court upheld the provisional release of the driver of former minister Moustapha Diop, as previously ordered by the investigating authorities.
The accused, Mouhamadou Bamba Amar, is being prosecuted for embezzlement of public funds as part of the investigation into the management of funds intended to combat the Covid-19 pandemic, following the revelations in the Court of Auditors' report.
Initially, the judge of the second investigating chamber of the Dakar court had ordered the provisional release of Mr. Amar under the regime of electronic surveillance, based on the "serious objections" raised by his lawyer, Mr. Cheikh Ahmadou Bamba Fall.
The public prosecutor appealed this decision. However, the indictment division upheld the investigating magistrate's order. As a last resort, the public prosecutor's office appealed to the Supreme Court.
By rejecting the appeal filed by the public prosecutor's office this Thursday, the Supreme Court definitively upheld the provisional release of the individual in question. Mouhamadou Bamba Amar will thus be able to leave detention pending the outcome of the investigation.
This case, however, remains linked to the proceedings against his former superior, Moustapha Diop, former Minister of Industrial Development and SMEs. Diop's case is currently before the High Court of Justice.
