The mason, M. Diakhaté, 30, is being prosecuted for abduction of a minor and indecent assault with violence. He is accused of taking 17-year-old A. Mbaye to his room in Mbour 1 (Thiès) and then committing sexual acts against her.
The two had initially met at the Nguinth roundabout. Charmed by A. Mbaye's daughter, the mason M. Diakhaté approached her and convinced her to go to his room, claiming he was going to buy her a meal. The mason took the girl to his room twice and allegedly forced her to perform sexual acts on her. When the minor's parents discovered these events, they filed a complaint with the police against M. Diakhaté for abduction of a minor and indecent assault with violence. He was subsequently arrested and remanded in custody.
In the dock of the Thiès court for flagrant offenses, the girl stated that the defendant had taken her to his room twice. She reported that the first time, the bricklayer served her a drink before making advances toward her with the intention of having sexual relations. She stated that when she tried to refuse, Mr. Diakhaté threatened her, then slapped her before undressing her. The girl added that the defendant wanted to penetrate her, but her vagina was tight. The victim emphasized that the situation came to light when she went to the bricklayer's house for the second time.
Her brother, B. Mbaye, who is legally responsible, reported that the girl once spent the night at the home of the mason, M. Diakhaté.
The defendant denied the charges. "I never committed a sexual act on her. I fell in love with her when I met her at the Nguinth roundabout and I wanted to marry her. I then took her home to introduce her to my mother. In my room, I served her a drink and we just talked," the accused stated.
The public prosecutor emphasized that the gynecologist's medical certificate confirmed that the victim had not been sexually penetrated, but that her genitals had been subjected to physical contact. He therefore deemed the defendant guilty and requested a two-year prison sentence.
The verdict is expected soon to determine the guilt of the accused in the face of charges of abduction of a minor and indecent assault with violence.
