ESCROQUERIE FONCIÈRE : Deux amies grugées de 4 400 000 FCFA par un peintre, un ancien militaire cité comme complice
The painter C. Sylla is being prosecuted for fraud, and his accomplices P. Ndao and A. Gaye for complicity. They are accused of having illegally sold two plots of land located in Keur Thieme (Thiès) to two friends, A. Seck and A. Sène.
These events took place in 2023.
Initially, it was Ms. A. Seck who expressed her desire to purchase land to former soldier P. Ndao. He then put her in touch with C. Sylla, who claimed to have two plots for sale in Keur Thieme at 2,700,000 FCFA each. After verifying the site, Ms. A. Seck paid an advance of 2 million FCFA to C. Sylla through P. Ndao. They then gave her a deed of sale signed by C. Sylla and countersigned by P. Ndao and Mr. A. Gaye. Ms. A. Seck added that she then gave P. Ndao 200,000 FCFA to pass on to C. Sylla. This was never done.
That said, Ms. A. Seck encouraged her friend A. Sène to buy the second plot of land. Ms. Sène also paid C. Sylla an advance of one million FCFA in order to receive a deed of sale signed by the seller and countersigned by P. Ndao and A. Gaye. She reported having given additional sums of 900,000 FCFA and 300,000 FCFA to A. Gaye and P. Ndao respectively, to be passed on to C. Sylla. This was also not done.
Each of them contributed 2,200,000 FCFA to acquire a plot of land.
As they were preparing to build on their plots, A. Seck and A. Sène noticed that other individuals had already erected foundations on the said land.
And when they contacted C. Sylla, it turned out he was in prison for another matter. So they filed a complaint with the gendarmerie against C. Sylla, P. Ndao, and A. Gaye for fraud and complicity.
The accused have been charged and placed in pre-trial detention.
In court, they admitted to the facts. C. Sylla confessed to selling two plots of land to the plaintiffs. He stated that these plots were undisputed and that the proceedings were delayed due to his imprisonment for other offenses unrelated to this case.
A. Gaye admitted to having received the sum of 900,000 FCFA from A. Sène without C. Sylla's knowledge, and promised to repay it.
P. Ndao also admitted to having received, without C. Sylla's knowledge, the sum of 200,000 FCFA from A. Seck and the sum of 300,000 FCFA from A. Sène.
The public prosecutor doubts the existence of these plots of land. He determined that C. Sylla is guilty of fraud and P. Ndao and A. Gaye of complicity. He then requested a one-year prison sentence for C. Sylla, two months for P. Ndao, and three months for A. Gaye.
The verdict is scheduled for December 26, 2025.
