Extradition de Doro Gaye : Les détails de la décision défavorable à l’État du Sénégal
Subject to an international arrest warrant, businessman Doro Gaye is now free. The Paris Court of Appeal ruled against his extradition request. He was being prosecuted by Senegalese authorities in a case of alleged fraud.
According to a ruling consulted by Seneweb, the French court believes that there is no reason to grant the request made by the State of Senegal.
The extradition request was based on an arrest warrant issued on October 25, 2024, by the 3rd investigating chamber of the Dakar High Court. Doro Gaye was being prosecuted for fraud allegedly committed between April 2 and October 25, 2024, in Dakar. These acts are defined and punishable under Article 379 of the Senegalese Penal Code and carry a sentence of up to ten years' imprisonment.
In its decision, the court did not simply reject the extradition request. It also ordered the lifting of the judicial supervision to which Doro Gaye had been subject in France since December 17, 2024, thus reinforcing the effects of its unfavorable opinion.
This decision represents a procedural setback for the State of Senegal. In extradition matters, an unfavorable opinion from the investigating chamber generally prevents the surrender of the person sought to the authorities of the requesting State.
The ruling also stipulates that the file will be sent to the Keeper of the Seals, the French Minister of Justice, accompanied by an authentic copy of the decision.
