Fatick Court: Acquittal for the nurse and the nursing assistant from the Ndiaye Ndiaye Wolof health post

Tribunal de Fatick : Relaxe pour l’infirmier et l’aide-soignante du poste de santé de Ndiaye Ndiaye Wolof

Tried before the court of flagrant offenses in Fatick, the head nurse of the post (ICP) G. Mb. and the nursing assistant AD of the health post of Ndiaye Ndiaye Wolof were acquitted after their appearance.

ICP G. Mbodj and nursing assistant A. Diouf were being prosecuted respectively for violating laws and regulations on burials and failing to assist a person in danger, following the death of young Seynabou, who was hit by a cart.

Admitted to the village health post, the victim was examined by the nursing assistant who administered paracetamol, having observed no apparent injuries or bleeding. "I informed the parents that if they noticed any complications, they should bring the child back," she stated in court, specifying that the head nurse was absent and that he had authorized her to provide care in his absence.

These statements were confirmed by the ICP. According to him, upon returning to the health post, the parents brought the child back a second time, but it was already too late, the victim having already passed away.

Because of his relationship with Mr. Touré, the victim's grandfather, the ICP agreed to keep the body in his office, as the local morgue was deemed unsafe. The following day, Mr. Touré came to collect it, but was not issued a death certificate.

The prosecutor requested a two-month suspended prison sentence and a 200,000 FCFA fine against the ICP, and a three-month suspended sentence with a 100,000 FCFA fine against the nursing assistant.

The defense argued for the acquittal of the defendants, believing that the caregiver had indeed provided assistance to the child by examining him, and that the ICP could not be prosecuted for violating burial laws, as the burial had not yet taken place at the time of his arrest.

At the end of the proceedings, the court finally acquitted G. Mbodj and A. Diouf due to reasonable doubt.

    Avez-vous requéri l'avis d'un autre professionnel de la santé pour avoir une meilleure idée du protocole en la matière, monsieur le Juge ? Doit-on simplement administré du Paracétamol à un accidenté et le laisser librement rentrer ? Le choc qui a nécessité son évacuation doit avoir été violent. Qu'est-ce qui a empêché de référer l'enfant au niveau du district pour voir s'il ne souffrait pas d'une hémorragie interne? Ce qui paraît être plus plausible.
    La légèreté aurait pu épargner le tribunal, dernier rempart de nos droits et libertés.
    Ce pays ne cesse de nous inquiéter. Franchement !
