The words sound similar, but they don't mean the same thing. In fact, the terms "interpellation" and "arrêt," which often appear in courtroom reports and police or gendarmerie cases, are often mistakenly used as synonyms. However, legally, their difference is very real. One precedes the other, and their implications are not the same.
According to journalist Daouda Mine, the arrest corresponds to a preliminary stage of the procedure.
"From the moment you are arrested, you are not under arrest. You keep your phone, your personal belongings, and you retain your rights," he explained during a training session for legal journalists on the theme of "The responsibility of the media in the dissemination of legal information." This course is organized by the Forum du liticiable (FJ) in partnership with COSCE and the NGO 3D, as part of the Saxal Jamm project.
In other words, this act allows law enforcement to detain a person for verification or questioning, without placing them in police custody. The person arrested remains free, as long as no coercive measures have been decided against them.
“Interpellation is the pre-arrest phase”
Arrest marks the moment when an individual's freedom is taken away. From that moment on, strict security measures are applied. "When you are in the arrest position, your belt, shoes, and phone are removed. You are now under the control of the law," explains Daouda Mine.
This step formalizes the status of the arrested person, who is now placed in police custody or detention. Their rights are governed by law, and they are placed at the disposal of the courts.
The legal commentator makes it clear that this distinction between these words is crucial for the proper functioning of criminal proceedings and respect for citizens' rights. "Interpellation is the pre-arrest phase. You can be questioned without being arrested, but you cannot be arrested without having been questioned," he says.
