Justice : Babacar Ba dénonce un traitement inégal dans les affaires Abdou Nguer et Cheikh Oumar Diagne
The president of the Forum of the Justiciable, Babacar Ba, protested against what he considers to be a difference in judicial treatment in two cases relating to similar facts.
In a statement, he emphasizes that Abdou Nguer, prosecuted for spreading false news, was placed under arrest warrant on February 18, 2026. Brought before the court on February 20 as part of the flagrant offense procedure, his case was adjourned to March 20, 2026.
On the other hand, Cheikh Oumar Diagne, prosecuted for the same acts, was placed under arrest warrant on March 9, 2026. Brought before the court on March 11, 2026 in flagrante delicto procedure, his case was retained and judged immediately.
For Babacar Ba, this difference in the treatment of two similar cases constitutes "a real breach of equality between citizens before the law".
According to him, applying justice differently to identical facts is likely to undermine citizens' confidence in the judicial institution.
"Such an attitude fuels legitimate suspicions against the justice system and reinforces the feeling of injustice among the public," he laments.
The president of the Forum of the Justiciable thus calls for strict adherence to the principle of equality before the law, which he considers a fundamental democratic requirement. In his view, its preservation is essential to guarantee the credibility of the judicial system, respect for fundamental rights, and the consolidation of the rule of law.
