Justice : TDS SA condamnée dans le litige avec Excaf Telecom
The Dakar Commercial Court has ruled in favor of the Excaf Telecom group in its dispute with the Senegalese Broadcasting Corporation (TDS SA). The announcement was made in a press release issued by Excaf Telecom on December 31, 2025.
According to the note, the court recognized the illegality of the withdrawal of the two commercial multiplexes operated by Excaf and ordered their immediate recommissioning, under penalty of 100,000 CFA francs per day of delay.
The court notably rejected TDS SA's objection contesting Excaf's standing to sue, found that no legal provision allowed TDS SA to unilaterally interrupt services, and recognized that the withdrawal of the two multiplexes lacked a legal basis. TDS SA was ordered to pay all costs.
Excaf Telecom emphasizes that this decision puts an end to "a major injustice that has profoundly weakened the company."
The group recalls having suffered considerable losses for more than 18 months, both financial and in terms of market share, trust with its partners, as well as serious harm to its employees and subscribers.
