La société civile veut la libération de Ismaila Madior Fall
Senegalese civil society has mobilized to demand the release of former minister Ismaila Madior Fall, who has been under house arrest with an electronic tag for over a year without trial. For these human rights advocates, this release should not be considered "a favor granted out of leniency, but rather a legal and moral imperative." This stance follows the arrest and detention of Cheikh Gueye, the businessman who had unjustly accused him.
Moundaye Cissé of the NGO 3D believes that the case of Ismaila Madior Fall, who was placed under house arrest with an electronic tag, deserves serious attention. "He is accused, then arrested, before being placed under house arrest with an electronic tag. Yet the person who accused him has just been remanded in custody for attempting to bribe a judge. And it turns out that he is a repeat offender," Moundaye Cissé of the NGO 3D stated during a television broadcast. This appeal to the current authorities is widely shared by the Forum of the Justiciable, for whom "this situation reflects a clear injustice. It makes him a scapegoat, sacrificed to give the illusion of implacable justice. But true justice cannot be built on flimsy accusations, contradictory testimonies, and empty procedures. It must be based on truth, fairness, and respect for fundamental rights."
The former Minister of Justice, who is enduring this ordeal with dignity and silence, had nevertheless vigorously contested the businessman's accusations. In vain. Was it resentment? Resignation? Who knows?
For his part, Alioune Tine, in a written statement on his Twitter account, believes that "all the accusations against him have collapsed like a house of cards and nothing justifies his house arrest anymore. The facts prove him right because his accuser is in prison for attempting to bribe a judge and has recanted his version of events."
Echoing Alioune Tine of Africa Jom Center, Babacar Bâ's Forum of the Justiciable believes that "Cheikh Gueye, who claimed to have bribed Ismaila Madior Fall, ended up contradicting himself and was convicted of bribing a judge. Thus, the main piece of evidence for the prosecution collapsed, revealing the inconsistency and fragility of the case. And yet, despite the evidence, Minister Ismaila Madior Fall remains under house arrest with an electronic tag, detained for a sham trial that has lost all justification."
Moundiaye Cissé also shares this view, believing that putting people under electronic bracelet for over a year without judging them is "like putting a sword of Damocles over their heads as if to ask them to be silent."
Paradoxically, according to the Forum of the Justiciable, "the public treasury has not lost a single franc. No harm has been caused to the State (...) The alleged facts have collapsed one after another, revealing a simple reality: Ismaila Madior Fall is innocent."
Finally, Alioune Tine concluded: “Ismaila Madior Fall, whose scientific and academic competence is beyond question, is one of the most convenient scapegoats because of his ‘blind’ loyalty to Macky Sall, sometimes sacrificing his reputation when he ironically proclaims himself the ‘haute couture tailor of the Constitution.’ I reiterate the need for a law on the presumption of innocence, to avoid unjustly damaging the honor of honest and upright people.”
