"Lettre ouverte à la Ministre de la Justice : Demande pour lever une injustice contre un investisseur mauritanien à Dakar"
Excellency Madam Minister of Justice,
Allow me to share with you an injustice I experienced in my second country, Senegal. I purchased a villa in Mamelles (Ouakam) several years ago. It was a very significant investment, the purpose of which was to live there with my family. But for personal reasons, I moved to Dubai.
So, I entrusted its management to a person who rented it to diplomatic missions or equivalent. But unfortunately, this manager found a better offer which he hid from me. It is a rental contract to a school "EDEN ACADEMIE SAS" running from August 1, 2021 to July 31, 2024 for an amount of 1,460,000 F. He only declared 860,000 F to me.
Sensing that something was fishy, I traveled to Dakar to investigate the scam. So, I established a new contract with the managers of EDEN ACADEMIE SAS for a period from April 1, 2022 to the end of December 2022 for a monthly amount of 860,000 FCFA, with an explicit evacuation clause at the end of the period.
But the managers refused to vacate the villa in December 2022, citing in court the first contract signed with the former manager and denying the existence of the second contract. Therefore, my lawyer then requested payment of the amount corresponding to the contract declared by EDEN.
The managers continued to pay only 860,000 CFA francs until July 2024, when they suspended all forms of payment. They have now been occupying the villa for 14 months without paying rent, despite the end of all the contracts.
The case, which was brought before the Commercial Lease, Business and Construction Litigation Chamber (BCEC) in Dakar, the judgment was postponed several times for reasons I do not understand. However, on August 14, 2025, the court ordered the immediate evacuation of the villa and ordered EDEN ACADEMIE SAS to pay part of the arrears, only 7,600,000 FCFA.
Immediately, the occupants filed an appeal, a purely dilatory appeal, thus presaging a new cycle of twists and turns, undermining the basic rights of the owner that I am but also without contractual basis and above all because the school is not in order in terms of payments.
To this end, and in view of the slowness of the justice system, which is causing me enormous harm, I sent a letter to the Minister of Justice on my case on July 10, 2025, hoping to find a satisfactory solution to my situation, especially to obtain the evacuation of my villa. I also tried, in vain, to meet HE Mr. Ousmane SONKO or Ms. Yacine FALL on the sidelines of the visit to the United Arab Emirates.
For this reason, I am taking this opportunity to draw the attention of the President of the Republic, the Prime Minister or the Minister of Justice to this situation of injustice of which I am a victim.
For this, I demand:
1. The immediate and effective execution of the judgment rendered by the court on August 14, 2025, in particular the part relating to the eviction of EDEN ACADEMIE SAS from the villa;
2. The order to pay the arrears that the court of first instance failed to take into account, divided into two parts:
Part 1: arrears corresponding to the difference between the two contracts for the period from April 1, 2022 to the end of August 2024 (29 months). Calculation: 600,000 × 29 = 17,400,000 FCFA.
Part 2: arrears of the full rent of the old contract, recognized by the court, for the period from September 1, 2024 to September 30, 2025 (13 months). Calculation: 1,460,000 × 13 = 18,980,000 FCFA.
Total arrears: 36,380,000 FCFA.
3. The obligation for occupants to pay all water, electricity and tax bills, as well as to repair any damage caused to the building during their period of occupation.
I therefore call on the leaders of this country to correct this incomprehensible and inexplicable injustice.
Tenants whose contracts expired more than a year ago and who refuse to pay the rental charges continue to occupy my villa, a real dispossession.
Contracts are available and could be attached immediately.

Pas la meilleure courtoise " d'accueillir" un nouveau Ministre de la justice. La Ministre n'est pas une Juge Monsieur. Affaire pendante devant le Tribunal.
Effectivement. Monsieur Cheikh Eleya, le ministre ne juge pas et ne s'immixera pas à ce niveau. Les contentieux judiciaires sont longs. La sagesse voudrait que vous soyez un peu patient. C.est mon.conseil. Il y a des millers de cas similaires au vôtre
Rendez-justice à ce monsieur. Il faut durcir la loi contre ces pratiques malheureusement courantes au Sénégal
La ministre n'a rien a voir avec cela. C'est aux tribunaux qu'il faudrait s'adresser. Imaginez un peu si chaque individu qui se setirait lese, s'adresse au ministre a la justice pour avoir gain de cause. Tu as apparemment les moyens de te prendre un avocat, pourquoi ne le fais-tu pas?
Qu’est ce qui n’a pas marché? Il voit dit qu’il a été en justice pour cette affaire très litigieuse , il a forcément un avocat!
Vous avez lu le texte. Il dit bien que son avocat a fait des diligences pour le paiement.

Il fallait que votre avocat exige une exécution du jugement nonobstant l'appel lors de votre 1ère audience comme cela même s'ils interjettent appel ils seront déjà dehors en train de faire leur appel.
Que Dieu vous assiste mais ce que vous demandez dans votre lettre ouverte se demande dans une requête devant un juge.

Monsieur, les senegalais ne peuvent pas investir en Mauritanie. et ne peuvent pas être propriétaires.
Donc vous n'avez aucun droit de propriété au Sénégal.

Sûr que tu n'es investisseur nulle part dans le monde. Ni au Sénégal ni en Mauritanie. Alors les gens qui en ont les moyens investir où il y a de la rentabilité et de la sécurité. Par contre, comme le dit quelqu'un plus haut, il faut arrêter de donner des titres fonciers aux étrangers comme ça se fait dans beaucoup de pays asiatiques comme la Thaïlande, Indonésie, Dubai etc
Aller casser les escaliers pour renovation, c est votre maison. Ils seront obliges de sortir.
Faut jamais donner à quelqu’un de gérer ses biens, ce pays est rempli de truands et de voleurs, ne jamais louer une villa longue durée. J’espère que justice sera faite pour vous et pour d’autres. Le changement aurait dû avoir lieu longtemps,

Nous espérons que la nouvelle ère au Sénégal, sous la conduite du Président Bassirou Diomaye Faye et du Premier ministre Sonko, mettra fin à ces pratiques abusives par des réformes juridiques, afin de préserver la réputation du Sénégal.
Nous copions tout sur la France pays où il est impossible d'expulser un squatter qui a accèdé à votre maison par effraction pendant votre absence. Sans contrat ni aucun papier. À ce train nous sommes en train de faire pareil.
Apparemment le monsieur fait appel à la ministre car la justice n’a pas résolu son problème et va dans le sens des gens qui habitent l’appartement
Il est clair que cet homme a été victime d’injustice et d’escroquerie, sa maison est occupée par d’autres personnes qui ne lui paient pas de loyer.
Notre pays, le Sénégal, ne doit pas permettre cela.
