ARRESTATION MAÏMOUNA NDOUR FAYE ET BABACAR FALL : Des avocats se prononcent
Following the arrest of journalists Maïmouna Ndour Faye and Babacar Fall, after their interview with Madiambal Diagne, lawyers interviewed by Seneweb gave their opinion on this case.
Speaking on condition of anonymity, a lawyer stated that the arrest of these two journalists infringes upon press freedom. He argues that there is no provision prohibiting a journalist from interviewing someone who is being prosecuted or subject to an arrest warrant. He added that it sometimes happens that individuals facing legal proceedings are interviewed openly.
One of his colleagues countered that, legally, interviewing a fugitive subject to an international arrest warrant is a way of defying justice. "Someone subject to an international arrest warrant is, in principle, someone wanted by the justice system. Regardless of their situation in their host country, they are wanted by the Senegalese justice system. When someone is wanted, it is assumed that they are untraceable. From this perspective, interviewing them publicly, while they are supposed to be untraceable and subject to an arrest warrant, can pose a legal problem. It's like saying I'm wanted, but I'm speaking out and exposing myself. It's a way of defying justice," he asserted.
Continuing his analysis, he expressed surprise that the French justice system had allowed Madiambal Diagne to speak to the press. The lawyer believes that if someone is in this situation, even if they remain under judicial supervision, they should be subject to certain obligations to avoid hindering the proper conduct of the investigation.
"In order not to undermine the authority of justice, someone in this state should not benefit from a number of rights. Domestically, when you are granted provisional release under judicial supervision, you are prohibited from speaking to the press and discussing the substance of the case," he explained.
The lawyer believes that the best course of action would have been for Senegal to lodge a protest with the French authorities and, if necessary, summon the French ambassador to Senegal. Because, he emphasized, international cooperation has rules.
Before adding: "The Press Code cannot solve this problem. The Press Code and the Code of Ethics address general issues. That is to say, issues of respect for professional ethics. The Press Code cannot solve the problem of someone who has legal troubles. The risk is that it will hinder the proper functioning of the justice system."
He concluded that journalists Maïmouna Ndour Faye and Babacar Fall might be at fault, but it's not certain they will face prosecution. According to him, the prosecutor's office could order arrests and then dismiss the case.
For his part, lawyer Alioune Badara Ndiaye cited Article 5 in conjunction with Article 57 of the Press Code, which, he said, prohibits a journalist from interviewing a person subject to an international arrest warrant. "Article 5 of the Press Code explicitly states that the confidentiality of an investigation must not be violated by a journalist. Article 57 states that in this case, there is a disturbance to public order. Madiambal is a fugitive. He is subject to an international arrest warrant and is wanted by the Senegalese justice system. Therefore, the journalist who interviews him is violating the provisions of Articles 5 and 57 of the Press Code," Mr. Ndiaye explained.
For him, we are simply applying the law, because it is forbidden for a journalist to do a show with a person who is wanted by the justice system, without, however, asking the express permission of the judicial authorities on the nature of the show, its objective and the intended content.
He stressed that this request can be rejected if the fugitive's offense is political, if his extradition is refused for political reasons, or if it could harm the investigation or the judicial proceedings.

Au bout de cette période ils lui tendent le micro pour en faire un héros. Mais dans quel pays vivons nous ? Porter en héros un voleur de derniers publics épinglé par un rapport de la centif et poursuivi par le pjf. Parce que c'est un pote journaliste et de la même sensibilité éditoriale. Toute presse qui promeut l'impunité pour un voleur fugitif doit être mis sous eteignoire.
Madambal s'il a quelque chose à dire qu'il déferre à sa convocation et apporte ses contestations au juge d'instruction. Quicquonque lui conseille autre chose que cela fait du dilatoire complice de vol et recel et doit être pénalement poursuivi d'autant qu'il le fait publiquement. Pire qu'il lui donne la tribune pour se defendre depuis l'étranger en statut de fugitif recherché.
Ces journalistes sont complices de fait de madambal et ils seront jugés conformément à la loi. Sans remords.
Madiambal veut se réfugier derrière la politique pour justifier ses forfaitures d’un homme d’affaires malhonnête. Le journalisme et la politique n’ont rien à voir avec la victimisation de ce bandit qui est Madiambal Diagne

A Madiambal ,la Justice senegalaises sait exactament ou il se trouve et j avoue meme connait son adresse complete en france,alors ,du coup, il n est plus recherché mais se trouve etre a l attente que le mandar d arret soit exsecuté ,si le Senegal a quelque chose a dire ,Ben il.n a qu a en faire la reclamación a la justice francaise,mais Pas oter la liberté de presse ,qui est garantie para la.constitution senegalaise.
Je me rappelle y a Pas longtemps un politicien qui etait recherché avait prefere Aller se barricarder dans SA ville Durant des semaines pendant que BCP de ses sympatisans se donnaient a des manifestations qui avaient conduit a des violences inedites Au senegal.
Ce que nous reclamions hier ,c est ce que nous sommes entrain de faire aujourdhui et je dirait meme pire.
Je ne Suis ni avec pastef ni encore moins avec un quelconque partí politique mais il est grand temps de trouver des solutions concretes pour soulager la population qui ne sait plus comment survivre avec la vie chere qui sevit dans le pays et arreter avec histoires a dormir debout.
On est fatigué et desespere pendant qu eux nous distraient avec des futilites.
Je vois que BCP de personnes sur les reseaux sociaux se sont habilles de costumes de magistrats et jugent aussi vote et s oublient de la presomption d innoscence.
