Mbour : Le verdict est tombé pour les six élus locaux de Saly

The verdict has been reached in the case opposing six local elected officials from Saly to the Senegalese Tourism Development and Promotion Company (SAPCO). Penda Seck, Babacar Guèye, Ibrahima Djigal, Ndongo Fall — president of zone 7C of Saly — Famara Dioly Sané and Bécaye Dieng were found guilty of the charges against them.

They were sentenced to two months' imprisonment, suspended. The court also awarded 12 million CFA francs in damages to the plaintiff.

The defendants were prosecuted for inciting participation in an unauthorized demonstration, acts of vandalism, disturbing public order and destruction of property belonging to others.

As a reminder, this case stems from a land dispute between elected officials and SAPCO. Believing they were victims of the dispossession of three hectares of land, the accused threatened, via social media, to disturb public order. In several widely circulated audio recordings, they called for resistance and action to protest what they considered an injustice.

These three hectares had been made available to Dame Fall for the organization of a fair. After the equipment was set up, a group of individuals stormed the site and vandalized the facilities. The events escalated into clashes between the defense and security forces (FDS) and some local residents.

In court, Ndongo Fall denied any incitement to vandalism. However, Penda Seck and Famara Dioly Sané admitted to having made statements in audio recordings calling for the destruction of the facilities.

For their part, Ibrahima Djigal and Babacar Guèye admitted to asking the people to invade the premises, while rejecting any responsibility for the acts of vandalism.

The court proceedings also revealed that a plan to set fire to the Savana Hotel, a site belonging to the Senegalese state, was allegedly considered by some of the protagonists.

Me Deh, the lawyer for the plaintiff, claimed 20 million CFA francs in damages.

For his part, Mr. Oumar Sène pleaded for acquittal on the grounds of reasonable doubt for his clients.

The court finally ruled, sentencing the six elected officials to a suspended sentence, along with financial compensation to be paid to the civil party.
