Peines allant de 5 à 10 ans, amende de 10 millions…: les détails du projet de loi de Sonko sur l’homosexualité, adopté en Commission
Bill No. 05/2026, amending Article 319 of the Penal Code relating to acts against nature, which had been announced by Prime Minister Ousmane Sonko, was adopted in committee work yesterday Monday at the National Assembly.
The Minister of Justice, Yassine Fall, who presented the reform, explained that it will further clarify the definition of the offense. Indeed, the draft text plans to list the acts against nature and remove the reference to "indecent acts," which was deemed too vague.
Regarding criminal penalties, she stated that "sentences are increased to ensure the law's deterrent effect." Currently, sentences range from one to five years imprisonment, in addition to a fine of 100,000 to 1,500,000 FCFA. The reform will increase sentences to five to ten years imprisonment, with fines ranging from 2,000,000 to 10,000,000 FCFA.
In cases of offenses committed against a minor, the maximum penalty will be applied. Regarding new offenses, the draft legislation will now make the false reporting, glorification, and financing of these acts punishable offenses.
Following discussions, the technical committee adopted the bill which will now be sent to the plenary session.
