The Indictment Chamber of the Financial Judicial Pool (PJF) will examine, starting at 10:00 AM this Wednesday, the prosecution's appeal contesting the decision of the senior investigating judge to grant provisional release to Pape Malick Ndour, with the wearing of an electronic bracelet, in the Prodac case. The former minister is charged in this case with criminal conspiracy, embezzlement of public funds, and money laundering. At the time of the alleged offenses, he was the program coordinator.
By granting Ndour provisional release after questioning him last November, the investigating judge disregarded the prosecutor's recommendation, which had sought a detention order. Before the Court of Appeal, the prosecutor hopes for a better outcome: the defendant's imprisonment.
To do this, the public prosecutor's office will have to convince them. "We will listen to them. Since they are the ones who appealed, it is up to them to say why they do not agree with the judge's decision and we will respond," warns Me Antoine Mbengue, one of the lawyers for the APR official, contacted by L'Observateur.
