Discours contraire aux bonnes mœurs : Modou Yade, mari de la disparue Lissa Tine, lourdement condamné
Trader Modou Yade, 40, married and father of nine, was tried this Monday in the Dakar court of flagrant offenses for speech contrary to good morals to the detriment of Modou Diouf.
In a live broadcast on TikTok, Modou Yade, husband of the missing Lissa Tine, called the civil party, president of the Justice for Lissa collective, all sorts of names.
In court, Modou Diouf stated that the defendant's remarks had deeply affected him and his family. His lawyers, including El Hadj Diouf, Aboubacry Barro, and Alioune Sawaré, requested that the defendant be found guilty and demanded 100 million CFA francs in damages, in addition to the removal of the video from TikTok.
Modou Yade, who apologized, said he acted in a fit of anger because the plaintiff accused him on a show of killing and burying his wife.
In his observations, the public prosecutor concluded that the defendant was guilty of the charges and requested a six-month prison sentence and a fine of 200,000 CFA francs. His lawyers, Khady Sèye Diallo and Ndèye Arame Seck, pleaded provocation and requested leniency in the application of the penal code.
In delivering its verdict, the court found Modou Yade guilty and sentenced him to three months in prison and 10 million CFA francs in damages. The judge reserved judgment on the civil party's request for additional compensation regarding the removal of the live video on TikTok.
