The defense team for the Senegalese supporters convicted in Morocco is preparing its response. Quoted by L'Observateur, Patrick Kabou, the lawyer handling the case, denounces the decision as unjust given the facts and the "chaotic" organization of the final.
A procedure contested on both substantive and procedural grounds
The lawyer argued that the proceedings were invalid, claiming that the law had been applied selectively. According to him, the court had improperly relied on Article 308 of the Moroccan Penal Code.
"They chose to raise only Article 308 [...] which only deals with supporters, whereas this article concerns the organizers (CAF) and the behavior of law enforcement."
The defense also rejected the charge of "disturbing public order," with Mr. Kabou telling the court that it was "impossible to talk about disturbing public order in a stadium."
Stewards singled out as responsible for the violence
According to the supporters' council, the incidents were triggered by the local stewards:
"Everything was fine until Brahim Diaz missed his penalty. That's when a steward hit a Senegalese supporter with a chair, then punched him."
Images produced by the defense show that the Senegalese police officers present had to act as a "buffer" to protect the supporters, while the stewards' behavior violated CAF protocol which prohibits them from striking.
"We plan to appeal."
While the civil party itself reportedly acknowledged that the Senegalese supporters were just as much victims of this chaotic organization, the defense expected a complete and unconditional acquittal.
“We plan to appeal,” stated Mr. Kabou. The firm is now awaiting a response from the Senegalese federal authorities to officially launch the procedure to contest these convictions.
