Thiès : Un mécanicien condamné pour avoir vendu un véhicule avec une fausse carte grise
F. Sène, a 35-year-old mechanic, was brought before the Thiès court for flagrant offenses on charges of fraud. He is accused of selling a vehicle with falsified administrative documents.
According to the complaint filed by the victim, Mr. Ndiaye had purchased the vehicle for 2 million FCFA. It was during a routine check at the Mines Department that he discovered the fraud: the vehicle registration document was a forgery. The document was immediately confiscated by the authorities.
Mr. Ndiaye then tried to recover his investment. While the mechanic reimbursed him an initial installment of 900,000 FCFA, he was slow to return the remaining 1,100,000 FCFA, which led to the case being taken to court.
In court, the defendant denied any intention of fraud, claiming he was unaware the vehicle registration document was falsified. Even more surprisingly, he admitted to reselling the vehicle to a third party as soon as Mr. Ndiaye returned it to him, despite the ongoing legal dispute.
Considering the facts to be established, the public prosecutor requested the application of the law. In his ruling, the judge found F. Sène guilty of fraud and sentenced him to six months' imprisonment, suspended. He will also have to pay the plaintiff the sum of 800,000 FCFA in damages.
