THIÈS : I. Mbaye, voleur présumé de téléphone, lynché et emprisonné, relaxé au bénéfice du doute
Thirty-four-year-old I. Mbaye escaped conviction. He was being prosecuted for stealing a mobile phone. On the night in question, he had gone to a bar. Intoxicated, he allegedly broke into a house to commit a robbery.
The plaintiff, A. Samb, stated that I. Mbaye had climbed the wall of his house to steal his niece Seynabou's cell phone. He was intercepted by a neighbor who had been watching from his terrace and who alerted the neighborhood. A. Samb emphasized that when they searched his backpack, they found the stolen phone.
I. Mbaye was lynched before being taken to the police and charged with theft, and placed under a detention order.
In the dock of the Thiès court for flagrant offenses, the defendant denied the accusations. He stated that he was drunk, but conscious. He denied having entered the house and specified that he had been arrested near the railway.
For his part, the public prosecutor requested the application of the law. However, the judge acquitted him due to reasonable doubt.
