Thiès : Pour deux mois de loyers impayés, il expulse ses locataires et les menace avec une machette

The Thiès court of flagrant offenses examined a case of death threats and illegal possession of a weapon involving Karim, a building electrician, prosecuted to the detriment of Mr. Guèye.

In court, the defendant explained that the plaintiffs had accumulated two months of rent arrears before leaving Thiès for Dakar without giving any news. "I warned them that they would be evicted if they did not settle their debt, but they did not react. I then broke down the door of their room and took out their luggage," he stated.

According to the case file, upon their return from Dakar, Mr. Guèye and his roommate, A. Ndiaye, were met by Karim, who was armed with a machete. The defendant informed them that they no longer had a room in the house and threatened to kill them. During the preliminary investigation, Karim admitted to the acts, claiming that he was under the influence of alcohol at the time.

In court, Mr. Guèye recounted that a neighbor had alerted him during his stay in Dakar, telling him that their bedroom door was open. Upon returning to Thiès with his roommate, they found their belongings removed from the room. He stated that Karim attempted to attack them with his machete, but they managed to subdue him and disarm him before filing a complaint at the Nguinth police station.

The plaintiff also stated that several of their belongings and documents had disappeared after their luggage was forcibly removed. However, he and his roommate announced that they had forgiven the defendant.

In his closing arguments, the public prosecutor requested that the charges be changed from death threats to assault and battery. He asked that Karim be found guilty of this offense as well as illegal possession of a firearm, and sentenced to one month's imprisonment.

The case has been adjourned for deliberation.
