Une histoire d’omelettes vire au cauchemar criminel : 15 ans de prison requis contre Djiby Diouf !
The prosecutor presiding over the criminal chamber of the Mbour High Court requested a 15-year prison sentence for 52-year-old Djiby Diouf. He is being prosecuted for the rape of A. Faye, a 14-year-old girl. The alleged crime took place on July 11, 2023.
According to statements made in court, F. Faye, the victim's aunt, had been alerted by K. Traoré, who claims to have caught Djiby Diouf in the company of the young girl in compromising circumstances.
A. Faye testified in court that the accused had repeatedly attempted to sexually assault her, taking advantage of the absence of other family members in the house. She alleges that he entered her room, removed his trousers, and then tried to remove hers. The young woman claims that he subjected her to these acts on two occasions and that on another occasion, she managed to escape.
The medical certificate included in the file attests to a past loss of the hymen, without however specifying the exact circumstances of this situation.
For his part, Djiby Diouf categorically denies the accusations. He explains that he went to his neighbors' house to ask them to prepare his breakfast. According to him, the victim's mother asked him to come inside to ask A. Faye to make her some omelets. He believes that K. Traoré then took advantage of the situation to falsely accuse him.
In court, K. Traoré maintained her accusations. She claimed to have seen A. Faye crouching in front of Djiby Diouf before discreetly returning to the room to verify what she thought she had seen. According to her account, she caught the victim putting on her pants while the accused zipped up his without turning around.
F. Faye, heard as a witness, stated that Djiby Diouf had come to tell her that his niece accused him of abusing A. Faye. After questioning K. Traoré, the latter reportedly confirmed her accusations.
In his closing argument, the prosecutor asserted that the alleged acts stemmed from the defendant's behavior and were committed under duress and coercion. He noted that rape cases typically occur without direct witnesses. The prosecutor therefore requested a 15-year prison sentence.
The defense, led by Rama Ba, denounced several contradictions in the statements of the victim and witnesses. The lawyer notably highlighted the inconsistencies in K. Traoré's testimony, who initially stated that he saw the two people zipping up their pants before later claiming to have caught them in the act of having sex.
Ms. Rama Ba also emphasized the absence of injuries and traces of semen in the medical file. Finally, she pointed out inconsistencies regarding the layout of the room, with the victim claiming to have been sitting on a chair while the witness maintains that there was no chair in the room.
The verdict in this case is expected on June 19, 2026.
