Ziguinchor : Magistrats, avocats, greffiers et huissiers de justice à l’école des procédures de recouvrement et des voies d’exécution
Magistrates, lawyers, clerks and bailiffs from the Ziguinchor region are in a training seminar on an essential instrument for regulating civil and commercial justice: the uniform act on the organization of recovery procedures and enforcement measures, which was adopted in 1998.
According to Souleymane Teliko, Director General of the Judicial Training Center (CFJ), this act was revised on October 17, 2023, following difficulties encountered in the processing of recovery and enforcement procedures.
"This revision is essentially dictated by the desire to strengthen legal certainty, to facilitate recovery procedures and enforcement measures. We deemed it necessary to bring together today all the stakeholders concerned, namely magistrates, lawyers, clerks, bailiffs, to discuss these new provisions, on the articulation with the national provisions concerning the referents. And all this with the aim of achieving a common and harmonized understanding of this legal framework," explained the Director General of the CFJ.
With the support of German cooperation, GIZ, Mr. Téliko hopes for a shared understanding and in-depth discussion of debt recovery procedures and enforcement measures among the key stakeholders through this training. "This harmonized, shared understanding will strengthen the judicial system and also improve the business climate," he emphasized.
The Director General of the CFJ emphasized that there are no specific provisions unique to the south of the country. "These provisions apply throughout the OHADA (Organization for the Harmonization of Business Law in Africa ) area, even beyond Senegal. There are no specific provisions unique to the south of the country. However, we believe that, given the difficulties encountered and the differences in interpretation among the various stakeholders, it is important to reach a harmonized understanding, because justice must function in a way that is understandable and accessible to all citizens," explained Souleymane Teliko.

Le climat des affaires est bien morose au Sénégal. Il faudrait une réforme urgente de la justice, Concernant l'exécution des décisions de justice. Les jugements surtout avec exécution provisoire doivent être exécutés. La France avec Sarkozy en prison pourrait être pris en exemple.
Il faut faire votre travail et appliquer les lois et la justice nul n’est au dessus des lois.
