The Access to Information Bill will be submitted to a plenary session this Tuesday, August 26, at the Senegalese National Assembly. This law defines citizens' rights to obtain information held by public entities while regulating exceptions and establishing an independent oversight authority. Here are five key takeaways from this bill, which has been eagerly awaited in Senegal for nearly two decades.

Universal right of access to information

Any natural person legally residing in Senegal may request and obtain information held by public entities, including central and local administrations and public bodies.

Free and easy to access

Access to information is free. Only fees related to reproduction or transmission may be charged. The process must be simple and quick for citizens.

Limited exceptions

Some information may be protected and not accessible: national defense secrets, judicial investigations, medical data, sensitive commercial or industrial information, and government deliberations.

Creation of CONAI (National Commission for Access to Information)

An independent administrative authority responsible for ensuring the protection and promotion of the right of access to information, raising awareness, training, investigating, making recommendations and publishing an annual report.

Obligations of public entities

Administrations must respond to requests within a specific time frame, put in place internal procedures to facilitate access to information and inform citizens of their rights.

    ENORME PROGRES EN MATIERE DE TRANSPARENCE! Par ex., les contrats signés avec les compagnies minières ou pétrolières ou toute autre société seront désormais très facilement accessibles à la presse et aux citoyens ; itou pour ces exonérations d'impôts en catimini ou les attributions foncières, pour ne donner que qques exemples. Aux USA et au Canada la FOIA (Freedom Of Information Act) et la LAI (Loi sur l'Accès à l'Information) ont fait que les différentes administrations ne peuvent pas se permettre de faire du n'importe quoi. A contrario, il ne devrait plus y avoir d'excuses pour la diffusion de fausses nouvelles qui doit être alors réprimée plus sévèrement.
