Access to Information: Ousmane Diagne clarifies guarantees and responds to MPs' concerns

During the committee's examination of Bill No. 14/2025 on access to information, Justice Minister Ousmane Diagne clarified the questions raised by members of the inter-committee, according to the report sent to the press. He emphasized the fundamental importance of this right and the measures planned to ensure its effectiveness. The Minister of Justice emphasized the inseparable link between the right of access to information and the availability of public data: "It is difficult to exercise a right if the practical conditions are not met."

Thus, the subject structures will have to make the information available within strict deadlines. An amendment sets a maximum of five days for referring an applicant to the competent body. To ensure the law's implementation, the text provides for the creation of the National Commission for Access to Information (CONAI), responsible for ensuring compliance with obligations, raising awareness and training citizens and administrations, and ensuring the regular updating of public sites to facilitate access to data. Asked about the risks of disinformation, the minister affirmed that this law constitutes a response to fake news by promoting reliable and regulated access to public information, accompanied by sanctions in the event of non-compliance.

Regarding the enforceability of this right against the State, he recalled that the latter has an obligation to inform citizens about public policies implemented on their behalf. Finally, he welcomed the MPs' proposal to integrate the National Audiovisual Regulatory Council (CNRA) into the CONAI, an option being considered for implementing decrees.

    Ce régime perd du temps avec des lois totalement inutiles pendant que tout que les urgence s' accentues de partout ces gens sont entrain de parler de lois qui ne serviront a rien ni maintenant ni après
