Adoption d’un décret pour un système de marquage fiscal contre la fraude
President Bassirou Diomaye Diakhar Faye signed decree no. 2025-1755 on Friday, establishing a mandatory tax marking system for certain categories of imported, exported, or locally produced goods. The stated objective is to combat commercial fraud, protect consumers, secure tax and customs revenues, and strengthen the competitiveness of national businesses.
Tax marking, defined as "the process of assigning a unique tax mark to a given product, considered individually," relies on QR codes, alphanumeric codes, or seals affixed to packaging or bulk products. "The tax mark directly contains, via a link, information relating to customs declaration and the payment of the various duties and taxes due," the decree specifies. This applies to: products subject to excise duties; exempt goods; and products whose export presents fiscal or economic implications.
The final list will be established by order of the Minister of Finance, Cheikh Diba, who spearheaded the project. In his explanatory report, he emphasizes: "Tax marking is a technique designed to ensure the traceability of products circulating within the national territory and to certify their tax compliance."
The system aims to protect Senegalese producers from unfair competition from illicit imports. "It guarantees protection for local businesses against unfair competition from imported products through the mandatory use of secure tax stamps," the report emphasizes. It also improves the traceability of pharmaceutical and food products.
The decree formally prohibits: possessing, selling or exporting products without a tax mark; manufacturing or using counterfeit marks; and harming the system (intrusion, counterfeiting, sabotage).
Infringements will be "prosecuted and punished as in customs matters," with possible seizure of goods. Marking must occur before any distribution or shipment.
The Customs Administration, in partnership with a private service provider appointed by the State, will oversee the technical deployment: brand generation, security, connectivity, and border and internal control. A ministerial decree will establish the practical details. This decree is part of a regional initiative to strengthen fiscal and trade governance, aligned with WAEMU and international standards. It will enter into force after publication in the Official Gazette.
