Assemblée nationale : La réponse de Me Tall à Me Moussa Bocar Thiam
The National Assembly adopted the indictment of former minister Moussa Bocar Thiam this Friday, February 27, 2026. During the plenary debates, Me Abdoulaye Tall, president of the Commission on Laws, Decentralization, Labor and Human Rights, responded to Moussa Bocar Thiam, contesting some of his objections to the regularity of the procedure.
Indeed, Mr. Tall pointed out that the impeachment procedure differs from traditional legal channels. "An impeachment is not a judgment. It is a procedural act by which the Assembly refers the matter to the High Court of Justice to allow justice to take its course," he emphasized.
He continued: “The High Court, governed by Article 101 of the Constitution, has jurisdiction to try members of the government for crimes or offenses committed in the exercise of their duties. Unlike ordinary judicial procedures, it is the Assembly that initiates the referral and not the public prosecutor, which is explained by the separation of powers and the specific nature of the jurisdiction. The investigating committee conducts the inquiry and can extend the indictment if other offenses are discovered.”
A simple denunciation may be enough.
In response to Moussa Bocar Thiam's arguments regarding the lack of an official report, Mr. Tall insisted: "An audit report is not necessary to initiate an investigation. A simple complaint, even from a citizen, can be enough for the justice system to act." He reminded the court that several proceedings before the Financial Judicial Pool have been opened based on simple complaints, and that those accused benefit at every stage from the presumption of innocence and can request provisional release under judicial supervision.
Furthermore, it should be noted that Moussa Bocar Thiam had requested the adjournment of the proceedings, citing a lack of legal basis and the violation of decisions of the Constitutional Council.
In response to this question, Mr. Tall clarified that "the Constitutional Council's decision of January 2025 does not prevent the Assembly from referring the matter to the High Court of Justice. Actions taken by a former minister in the exercise of his duties remain subject to the jurisdiction of the High Court. The impeachment resolution fully complies with the Constitution and the organic laws in force."
According to him, the indictment is also an act of protecting the public interest: "Public funds are not the property of ministers. Their misappropriation constitutes a betrayal of the mandate of trust granted by the people."
Mr. Tall reminded everyone that "we are not acting as judges. We are fulfilling our constitutional responsibility as guardians of the public interest and protectors of public funds. Senegal does not compromise on the integrity of its leaders."
