Révision constitutionnelle : « Impossible sans une collaboration avec le président », selon le Dr Yaya Niang
The controversy surrounding potential restrictions on the right to dissolve the National Assembly has brought the rules for constitutional revision in Senegal back to the forefront of the debate. Responding to reports of an initiative by the Pastef party, constitutional expert Dr. Yaya Niang reiterated the legal foundations that govern any reform.
“In Senegal, no constitutional revision is possible without collaboration with the President of the Republic,” he stated, emphasizing that the National Assembly does not have autonomous power in this matter. While it can initiate a proposal for revision, this proposal cannot succeed without the involvement of the Head of State, he clarified.
The legal expert acknowledges, however, that Parliament can, in certain circumstances, compensate for a failure by the president to promulgate laws. But, according to him, the issue goes beyond this procedural framework and relates to the institutional balances defined by the Constitution.
The lawyer made these clarifications as, according to several media outlets, the leader of Pastef, Ousmane Sonko, is considering submitting a bill aimed at strictly regulating the right to dissolve the National Assembly.
The text would notably provide for limiting this prerogative to a single use per presidential term.
Any second dissolution would force the head of state to put his mandate on the line through an early presidential election.
