Controverse sur la déclaration de patrimoine du Président : l’éclairage d’un ancien membre de l’OFNAC
The debate rages on. Former MP Doudou Wade criticizes the bill on asset declarations, which he considers inconsistent: according to him, it is illogical to require a declaration upon the President of the Republic taking office without imposing one at the end of the term. "There's no point in requiring a declaration upon entering if it's not required upon leaving," he asserts.
Amadou Ba (Pastef), a member of parliament in the 15th legislature, countered that this issue is governed by Article 37 of the Constitution, a standard that is superior to any ordinary law. According to him, the bill cannot therefore include this obligation.
Questioned by L'Observateur, Abdou Kane, a lawyer at the Court and former member of OFNAC, is decisive: he says he is in favor of a declaration of assets at the end of the presidential mandate, in the name of efficiency, consistency, integrity and exemplarity.
He emphasizes, however, that incorporating such a provision into current law is legally complex. Mr. Kane argues that this responsibility should be entrusted to the Constitutional Council, which, according to him, is the only body authorized to oversee this type of control, in order to preserve the stature of the presidential office.
Regarding the possible extension of the obligation to members of the National Assembly office, the source from the daily newspaper of the Future Media Group considers this unnecessary, unless they manage public funds.
Finally, the latter warns of the logistical difficulties that a massive expansion of the number of people subject to tax would cause. The only viable solution, according to him, would be the complete digitalization of the system, to enable efficient, secure, and centralized processing of declarations.

A partir de là et très sincèrement à quoi servirai de connaitre le patrimoine du Président à sa prise de fonction et ne pas connaitre le même patrimoine à la sortie.
Il s'agit d'une loi du TOUT ou RIEN. Entre les 2, il n'y a pas lieu de parler de sincérité.

En effet, la loi de l’Ofnac ne pouvant concerner le PR, il aurait dû appeler les députés à s’attaquer aux dispositions constitutionnelles sur la déclaration de patrimoine du PR; parce que c’est la constitution qu’il faudra modifier et la ce n’est pas simple.
Une lois est impersonnelle! Sauf si, cette lois est faite en Afrique: Soit pour proteger quelqu'un, soit viser/incriminer quelqu'un autre!!
C'est comme l'autre evt. projes lois ou on veut/voulait saisir les biens d'un accuse (donc, qui n'a pas ete juge), apres sa mort!!
Comment peut-on penser/avancer de conneries pareilles! J'ai entendu ce evt. projet de loi, je me suis dit:'Ils font cette lois pour Farba Ngom! Si elle passe, elle viserait principalement Mr. Farba Ngom! Et avec toutes ces conneries vous voulez qu'on se developpe? On se developpra jamais!!!
