Maitre Moussa Diop : « Il faut que les tenants du pouvoir aillent à l’école de la démocratie »
Invited to comment on the arrest of journalists Babacar Fall and Maimouna Ndour Faye, after their respective interviews with Madiambal Diagne, Maitre Moussa Diop denounces a "worrying drift" against press freedom.
Speaking on the "Grand Jury" program on RFM this Sunday, November 2nd, the former director of Dakar Dem Dikk stated that no Senegalese law prohibits a journalist from interviewing a wanted person. He believes this case symbolizes a serious attack on freedom of information.
“Can we deny journalists the right to interview someone in the interest of the news, even if that person is subject to an international arrest warrant? We cannot refuse,” he insists. For the legal expert, “what we are witnessing is truly the beginning of a dictatorship.”
To support his claims, Mr. Diop cites several precedents: “The Prime Minister of Senegal, now president of the Pastef party, had taken refuge in Casamance after being summoned by the courts. He was interviewed by Pierre Édouard Faye of Walfadjri. Was Pierre Édouard Faye harassed? No. And yet, he was a fugitive,” he points out. According to him, the same situation applies to “Ngagne Demba Touré, who had taken refuge in Mali and was interviewed without the journalist being harassed.”
Furthermore, the lawyer believes that this case illustrates a confusion of powers. "The orders appear to have been political, not judicial."
According to him, "the prosecutor was not informed of the situation and was presented with a fait accompli," he added. The president of the Generational Alternative party (AG/Jotna) believes that those in power lack a sense of democracy. "The judiciary must be independent. The Minister of Justice is a political authority, not a judicial one. It is the magistrates who administer justice, not the ministers. Those in power need to learn about democracy," he said.

L’exemplaire de Sonko est vraiment pas pertinent car Sonko devrait être jugé. Il a été jugé par contumace. Or le dossier de Mandiabale est en instruction
