Pavages des rues et places publiques : l'ARCOP freine la mairie de Yoff
The project to pave the streets and public squares of the municipality of Yoff, financed by the Pacasen program, has been halted. Following a complaint filed by the company Safi Costruzione Sarl, the Public Procurement Regulatory Authority (ARCOP) has ordered a reassessment of the bid evaluation process, citing serious shortcomings in the award procedure.
According to Libération, which reported the information, the contract was initially provisionally awarded to Fidèle Sarl for 240,909,980 CFA francs. However, Safi Costruzione, whose bid was lower, raised several irregularities in the procedure.
She first denounced a late notification of her rejection, which occurred on December 12, two days after the publication of the provisional award notice, which, according to her, compromised the effective exercise of her right of appeal.
The applicant then contests the reasons put forward by the town hall, in particular the alleged absence of the 2024 financial statements, whereas the minutes of the opening of the bids expressly mention the production of this document.
Finally, Safi Costruzione cites a breach of the principle of equal treatment, pointing out that the provisional awardee, Fidèle Sarl, was selected despite the non-production of a line of credit certificate, which was required in the tender documents, the newspaper details.
The ARCOP decision
After suspending the procedure, the same source concluded, the Dispute Settlement Committee (CRD) ultimately ruled in favor of the contesting party. The regulatory authority determined that the principles of transparency, cost-effectiveness, and equal treatment of candidates had been violated. Consequently, the Yoff municipality has been ordered to restart the evaluation of the bids, thus reopening the competition to all six initial bidders.
