L'état mental de Farba Ngom, l'affaire des téléphones : le cri du cœur de Me Doudou Ndoye
Invited to the program "Le Jury du Dimanche" on iRadio, lawyer Doudou Ndoye painted a worrying picture of his client Farba Ngom's situation. He denounced the continued detention, which he considers profoundly unjust, and expressed concern about the health of the former mayor and member of parliament for Agnam.
From the outset, Mr. Ndoye made no secret of his apprehension. Following a recent visit to the prison, he stated that his client had lost his usual fighting spirit. "When I saw him, he didn't seem well, neither morally nor mentally," he confided. According to him, this decline contrasts sharply with the moral strength Farba Ngom had always demonstrated in the past, even in the face of illness.
A "double injustice" – legal and factual
At the heart of his argument, the lawyer denounced what he called a double injustice. He pointed out that the judicial authorities had already ordered his client's release: first the investigating judge, then the indictment division. However, the appeal filed by the public prosecutor's office with the Supreme Court is blocking the execution of these decisions. For the lawyer, this procedural obstinacy is incomprehensible.
Attorney Doudou Ndoye also points to a major inconsistency in the handling of the case: "One man is told: 'You did nothing wrong, go home.' And the other: 'You helped him do nothing, so you stay in prison.'" In his view, this situation illustrates a blatant breach of the principle of equality before the law.
The phone case: a procedural "slippage"?
The lawyer also addressed the opening of a new case related to the use of cell phones in detention. According to Mr. Ndoye, these actions fall strictly under the prison's internal regulations and do not constitute a criminal prosecution. Transforming this incident into a legal case, he argued, represents a worrying trend.
Despite these harsh criticisms, the lawyer clarified that several appeals are still pending and that Supreme Court decisions are expected in the coming weeks. In the meantime, he reiterated his position: Farba Ngom's continued detention has no justifiable basis. "Before imprisoning someone, you have to be sure they actually committed the crime. Otherwise, the whole of society is in danger," the Sunday guest concluded.
