Affaire de l’usine de fer Buildmart : Contrôle judiciaire pour les deux Indiens et le commerçant sénégalais
Endangering the lives of others and illegal business practices! These are the charges brought by the prosecutor of Pikine-Guédiawaye against the owner of the Buildmart factory, Ajay Giri, his production manager, and the merchant Abdoulaye Fall. But contrary to the prosecution's recommendations, the investigating judge of the 2nd chamber decided to place them under judicial supervision.
In this case, revealed by the newspaper "Libération," it all started with an inspection carried out by the departmental trade service on a batch of iron belonging to the merchant Abdoulaye Fall. The agents noted that the declared diameter of the iron was small. The merchant had agreed to pay a fine.
The head of the department then informed the prosecutor, who ordered the arrest of the owner of the Buildmart factory, its production manager and the trader for endangering the lives of others and illegal business practices.
After their custody, the three accused were brought before the prosecutor's office, which requested the opening of a judicial investigation and sought a warrant for their detention.
After several appearances before the prosecutor's office, they were finally questioned this Thursday by the investigating magistrate. Their lawyers, Takha Cissé, El Hadj Diouf, and Daouda Ka, contested the charges, arguing that no victims had been identified in the case. They also maintained that the Meteorological Directorate had acknowledged using this type of iron solely as tie wire. The defense further pointed out that the recently established Buildmart factory produces high-quality iron, a fact confirmed by administrative authorities. A delegation from Aprosi had even visited the police station during the suspects' detention.
Relying on Law No. 2021-25 of April 12, 2021 relating to prices and consumer protection, the defense asked the judge not to follow the prosecution's requests, highlighting doubts about the materiality and attribution of the offenses.
The investigating judge placed them under judicial supervision.

Trop facile comme argument de la part des avocat, parce qu'il n'y a pas eu de victimes donc ils sont innocents. C.est comme si on te donnait une contravention pour exces de vitesse et que tu conteste cette contravention disant que tu n'as pas fait de victimes. S'ils manipulent les normes de fers qu'ils osnt sence produire, c'est un delit grave en soi meme sans victimes.
Est ce que ce produit a passé a travers les règle de la normalisation avant sa mise sur le marche ? .Deux indiens se lèvent , fabriquent du fer recyclé pour bâtiment sans les autorisations préalables. C est du n importe quoi dans ce pays.
Les Indiens ki font du commerce sont cupides et pret a tout pour des sous.Le Senegal doit etre intrangisant sir ces pratiques frauduleuses.Voila la raison pourquoi les maisons s’éffondre.
