Mr. Kâ, a car washer, appeared before the Thiès court for flagrant offenses on charges of aggravated robbery committed at night in Keur Daouda Cissé, in the Thiès region. He is being prosecuted for stealing an ox with an accomplice who is still at large.

In court, civil party A. Sow explained that the two individuals were leading the animal toward an unknown destination when the ox refused to move. This behavior aroused the suspicions of witness M. Ndao. He added that the suspects fled and the animal was later recovered.

Following the investigation, Mr. Kâ was arrested while his alleged accomplice remains at large.

The defendant, however, rejected all the accusations. He claimed that the witness, Mr. Ndao, was his enemy and that he had fabricated the case against him.

Called as a witness, Mr. Ndao, a motorcycle taxi driver in Jakarta, confirmed his statements made during the investigation. He recounted that while transporting a client at night, he saw Mr. Kâ with another man leading the ox. He stated that he positively recognized him and even called out to him to ask if the animal belonged to him.

The witness added that when he first tried to stop them, the fleeing man brandished a machete, forcing him to retreat. He then went to get backup from his brothers before pursuing the suspects. The group followed their trail as far as Tawa Fall, where the two men finally abandoned the ox and fled.

Considering the facts sufficiently established, the deputy public prosecutor asked the court to find Mr. Kâ guilty of aggravated robbery committed at night. The prosecution requested a two-year prison sentence and a fine of 200,000 FCFA.

The judge reclassified the charges as receiving stolen goods and sentenced the defendant to 3 months in prison.
