Expropriation compensation: total confusion surrounding the State's 4 billion CFA francs, the agent dribbles the heirs

A certain El HA Ndoye was arrested and referred to the public prosecutor's office by the Dakar Research Section last Wednesday for breach of trust. He is the subject of complaints from the heirs of the deceased Abdoulaye Ndoye, Mour Ndoye, and Baïtyr Samb, who were entitled, in 2017, to compensation from the State of Senegal of 4,850,000 CFA francs in exchange for the expropriation of land titles belonging to them for public utility reasons.

The defendant was the representative of the plaintiffs in the proceedings for the recovery of the compensation in question; which was to be paid in installments.

According to the accusation, reported by Libération, which reported on the case in its Thursday edition, El HA Ndoye has not paid the beneficiaries the full amount they have already recovered. The damage is estimated at 847.21 million CFA francs, according to the newspaper.

In front of the gendarmes, reports the same source, El HA Ndoye claimed a commission equivalent to 1/6 of the amount of the compensation to compensate him for the steps he allegedly took to obtain the 4 billion 85 million CFA francs. Also, he affirmed that the State of Senegal had committed to making an initial payment of 2 billion 42 million 500 thousand CFA francs, but had not released the envelope within the agreed deadline.

The accused claims that in the meantime, he took out a loan from a bank that was used to pay intermediaries who helped advance his case. Among these beneficiaries, he cites agents from the Budget Department and the lending bank.

"It was only after having released these sums [from the total amount paid by the State] that he would have divided the remainder into four parts, two of which, for a total amount of 678 million 491 thousand CFA francs, went to the families of the late Abdoulaye Ndoye and Mour Ndoye," reports Libération.

Regarding Baïtyr Samb's family, El HA Ndoye declared, according to Libération, that he had kept his share pending the settlement of a dispute between its members and businessman Tahirou Sarr.

The newspaper emphasizes that these dubious claims are "dispelled by several elements of the file."

    Je relève un fait très fréquent dans l'administration qui consiste à intéresser des agents pour que son dossier puisse être diligenté. Cela est gravissime car l'usager a droit légitime à ce que le fonctionnaire fasse son travail correctement sans attendre de lui quoi que ce soit. Ce que je dis est visible à la direction de l'urbanisme où pour obtenir une autorisation de lotir, on vous demande des terrains sur le site à lotir.
    Ceci arrive également dans certains services pour recevoir le paiement de l'état sur certains denrées subventionnés.
    En gros il faut que la loi sur les lanceurs d'alerte soit rapidement adoptée pour que de tels fait soit dénoncés.

    Je sais une chose. L'intermédiation est la chose qui marche le plus au Sénégal. Bcp de gens, surtout les fonctionnaires, sur une seule transaction font l'équivalent de 100ans de salaires. Souvent c'est ni vu ni connu. Je connais personnellement un fonctionnaire qui a acheté une villa à 500 millions cash grace à la commission qu'il avait tirée sur la vente de certains biens d'une entreprise publique.

    Tiéy les mandataires et les notaires. daniouye complot ba paré, notaire bi ni mome yeuguoule li khéw…il n’est pas au coutant. mais les preuves sont tétues…..
