Fonds Covid-19 : La Cour suprême annule la liberté provisoire de l’ex-DAGE Ndèye Aminata Loum
A new legal twist in the Force Covid-19 fund case. On Thursday, December 18, 2025, the Supreme Court overturned the ruling of the Indictment Chamber that had granted provisional release to Ndèye Aminata Loum Ndiaye. The former ministerial administrator therefore remains in detention.
The case of Ndèye Aminata Loum Ndiaye, former Director of General Administration and Equipment (DAGE) at the Ministry of Industrial Development and SMEs, has taken a decisive turn before the highest court. Charged with embezzlement of public funds by the judge of the 2nd chamber of the Dakar court, she is at the heart of investigations related to alleged irregularities in the management of funds intended for the fight against the pandemic.
The legal process for this request for provisional release was marked by strong opposition from the public prosecutor's office. Initially, the investigating judge granted the request of the defendant's lawyers, Sally Mamadou Thiam and Abou Allassane Diallo. This decision was upheld by the Indictment Division of the Court of Appeal, despite an appeal filed by the Public Prosecutor.
It was ultimately the public prosecutor's office that returned to the charge by filing an appeal to the Court of Cassation to obtain the annulment of this release.
Notable development at this morning's hearing: the Supreme Court chose to overturn the ruling of the Indictment Chamber, thus going against the requests of the Attorney General's office, which, during the hearing, had aimed to reject the appeal.
This decision means that Ndèye Aminata Loum Ndiaye remains in pretrial detention. The case now returns to a judicial waiting period, thus prolonging the former Director of Public Finances' detention in this closely watched case concerning the management of public funds.
