Litige commercial : un commerçant accusé d’avoir « détourné » plus de 5 millions FCFA de marchandises
In Thiès, a case of breach of trust pits a wholesaler against one of her loyal customers. The businesswoman, A. Dioh, accuses the retailer, D. Ndiaye, of owing her 5,475,000 FCFA, corresponding to a large unpaid delivery of goods.
According to the plaintiff, D. Ndiaye had been a regular and reliable partner until now. "He approached me to supply him with goods. During the first three transactions, he had always paid me the full amount due," she explained in court.
However, the relationship of trust broke down during the last delivery. Valued at 5,475,000 FCFA, this order was never fulfilled. "Since that delivery, they have been slow to pay me. I have taken several steps to get what I am owed, but without success," laments A. Dioh.
Faced with what she considers a clear refusal to pay, the wholesaler claims she had no other choice but to take legal action. She has therefore filed a complaint against D. Ndiaye for breach of trust.
The case was recently examined by the criminal chamber of the Thiès High Court. It should be noted that the defendant was absent from the hearing. Speaking before the court, the public prosecutor requested that the law be applied.
The verdict is expected on April 7, 2026.
